Pocketstop values your privacy. This policy applies to the Pocketstop Messaging services (collectively, the “Services”) known as RedFlag.

This Privacy Policy describes the types of personal and non-personal information we collect when you use the Service, how we use such information and to whom and under what circumstances we may disclose it. By accessing or using the RedFlag Service, you acknowledge that this Privacy Policy is part of our Terms of Service and you agree to be bound by all terms. If you do not agree to these terms, please do not use the Service.

The term “Client” will be used to refer to a person, entity, organization, or agency that has executed a Services Agreement with Pocketstop to use the Services. Accordingly, any information provided to Pocketstop about the Client and all approved users (“Contributors”) of the service will be referred to as “Client Data”. Client shall be responsible for informing all Contributors of the Terms of Service and this Privacy Policy.

The term “Subscriber” will be used to refer to the intended message recipient of Client who has in turn previously provided the Client all necessary permission to send them messages via any appropriate channels. Accordingly, “Subscriber data” will be used to refer to the contact information of a subscriber, which has been provided to Pocketstop via the Messaging Services website.

The “Messaging Services” will be made available only to Client’s who have previously executed a Services Agreement with Pocketstop, in connection with the RedFlag service. The Messaging Services facilitate the distribution of messages via varying communication channels including but not limited to Email, SMS, Voice Call and Social Media.

The term “Services Agreement” will be used to refer to the separate written contract executed by Client in accordance with the granted license of the Messaging Services.

Personal Information. When a client agrees to license the Messaging Service, Client will need to provide information pertaining to the Client, Individual Contributors and the intended individual Subscribers. The Client, Contributor and Subscriber information will vary and may include, name, electronic mail address, telephone number, or any other identifier to enable contact. When submitting this information via the Pocketstop Website, RedFlag Website or through any data import process, Client is granting permission for the collection, use, and disclosure of this information in accordance with the Terms of Service and with this Privacy Policy. To edit any of this information, contributors can access the Messaging Service Website. It is the Client’s responsibility to promptly update all Client, Contributor and Subscriber Data changes, and keep all information, accurate, current, and complete.

Partners. We provide some of our services through contractual arrangements with affiliates, services providers, partners and other third parties. We and our service partners use Client and Subscriber Data to operate our services and to facilitate the delivery of the Messaging Services. We require our service providers to handle Client and Subscriber information in a manner that does not violate this PRIVACY POLICY.

Subscriber Opt Out. If you are the recipient of a communication using the Messaging Services and wish to stop receiving communications, please access the subscriber registration portal connected to the entity that dispatched the original communication to you. Please understand that it may be impossible to completely delete your information without some residual information because of backups.

Message Distribution Rules Prior to sending any messages using the Messaging Services, Client represents and warrants that (i) Client has obtained all necessary permissions from all subscribers, to provide the Subscriber Data to Pocketstop in connection with the Service; (ii) to the best of Client’s knowledge, all the Client, Contributor and Subscriber Data is correct and complete; (iii) Client is authorized to send messages to each intended subscriber via any of the communication mediums; (iv) Client will provide each subscriber with a facility to withdraw his, her or its permission, and will not send messages to any subscriber upon receipt of an opt out request; (v) Client will seek to comply with all relevant federal and state laws and regulations including, without limitation, the CAN-SPAM Act of 2003, the Do Not Call Provisions of the Federal Trade Commission’s Telemarketing Sales Rule, and State Do Not Call laws, in the conduct of your actions regarding the subject-matter of this Agreement.

Subscriber Obligations. All Subscribers using the Messaging Services are required to use a unique username and password. Pocketstop recommends that the subscriber does not divulge the password to anyone. Pocketstop cannot be held accountable for activity resulting from Subscriber negligence in safeguarding the secrecy of their password. Pocketstop recommends a subscriber utilize the logout function after using the system.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect Client and Subscriber Data, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between Client and Pocketstop through the Pocketstop Website or RedFlag Website cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you.

 As we continue to develop our business, we might undergo a change of ownership such as a merger and/or a sale of all or substantially all our stock or assets. In such transactions, Client and Subscriber Data, are generally some of the transferred business assets, and by submitting Client and Subscriber Data on the Pocketstop Website or RedFlag Website, through data import, or any other means, you agree that Client and Subscriber Data may be transferred to such parties in these circumstances. However, any party purchasing our assets will be subject to an obligation to maintain the integrity of your information.

CHANGES TO PRIVACY POLICY Pocketstop may change this Privacy Policy at any time. It is your responsibility to review the Pocketstop Website and RedFlag Website to view the Privacy Policy periodically and any changes will be effective immediately upon posting. Your continued use of the Messaging Services after modification will constitute your acknowledgment of the modified Privacy Policy and your agreement to abide and be bound by the modified Privacy Policy.
